Terms of Service – Flip Gear
These Terms of Service ("Terms") govern your access to and use of Flip Gear, including our website, products, services, checkout, and customer support.
By accessing our website or placing an order with Flip Gear, you enter into a contract with us subject to the terms and policies properly presented and incorporated into your purchase.
Nothing in these Terms excludes, restricts, or replaces statutory consumer rights that cannot lawfully be excluded.
1. General Conditions
By using Flip Gear or purchasing from us, you confirm that you are legally capable of entering into the applicable transaction and that the information you provide is accurate and complete.
You may not use our website, products, checkout, payment systems, promotions, or services for any unlawful, fraudulent, abusive, or unauthorised purpose.
Flip Gear may reasonably refuse service, restrict access, cancel affected orders, or restrict future purchases where there is evidence of fraud, abuse, security concerns, or violation of these Terms, subject to applicable law.
2. Product Information
Flip Gear makes reasonable efforts to ensure that product descriptions, photographs, specifications, sizing information, colours, features, and pricing are accurate.
Customers are responsible for reviewing the applicable product description, specifications, sizing information, compatibility information, and other relevant details before placing an order.
Minor differences that do not materially alter the product may occur because of manufacturing batches, production updates, photography, lighting, or device display settings.
Nothing in this section permits Flip Gear to supply goods that are materially different from their description or otherwise fail to conform to applicable consumer law.
3. Manufacturing & Product Variations
Flip Gear works with multiple manufacturers and suppliers. As a result, reasonable non-material variations may occasionally occur between production batches.
These may include minor differences in:
- Colour tone
- Stitching or finishing
- Packaging
- Internal labels
- Accessories or inserts
- Minor measurements
- Other non-material production characteristics
A minor manufacturing or batch variation that does not materially change the product from its description does not by itself constitute a defect or product misrepresentation.
This provision does not apply where the product received is genuinely faulty, incorrect, unsafe, damaged, or materially different from what was advertised.
4. Global Manufacturing & Fulfilment
Flip Gear operates using an international supply, manufacturing, and fulfilment network.
We may work with approved manufacturers, suppliers, sourcing partners, warehouses, fulfilment centres, and logistics providers located in different countries.
Products purchased from Flip Gear may therefore be manufactured, stored, packaged, processed, fulfilled, or dispatched from international locations, including China or other countries outside the customer's country of residence.
The country from which an order is dispatched does not necessarily represent Flip Gear's principal business location.
Tracking information, shipping labels, customs documents, parcel packaging, or courier updates may reference a third-party manufacturer, supplier, warehouse, logistics provider, or international fulfilment centre.
The appearance of China or another international location in tracking, packaging, customs information, or shipping documentation does not by itself mean that a product is counterfeit, unauthorised, defective, incorrectly supplied, or misrepresented.
Nothing in this section restricts statutory rights where the actual goods supplied are faulty, damaged, incorrect, unsafe, or materially not as described.
5. Third-Party Manufacturers & Suppliers
Flip Gear may source products from third-party manufacturers and suppliers selected according to our commercial and operational requirements.
Products may be shipped directly from an approved supplier or fulfilment partner to the customer.
External parcel packaging may therefore contain supplier, warehouse, manufacturer, customs, or logistics information.
Differences in external packaging, shipping labels, fulfilment locations, or courier branding do not by themselves constitute grounds for a product-defect or misrepresentation claim.
6. Prices & Payments
The applicable product price, shipping charges, discounts, taxes collected by Flip Gear where applicable, and total amount payable will be displayed during the purchasing process.
Customers are responsible for reviewing the total amount before confirming payment.
Orders will generally not enter fulfilment until the applicable payment has been successfully authorised.
Flip Gear may correct genuine technical, pricing, or listing errors where permitted by applicable law.
7. Promotions & Discount Codes
Flip Gear may offer promotional codes, discounts, gifts, store credit, limited-time offers, or other promotional benefits.
Promotions may be subject to additional conditions disclosed as part of the applicable offer.
Unless otherwise stated, promotional offers may not be combined.
Customers must not create multiple accounts, identities, or orders for the purpose of repeatedly obtaining introductory promotions or otherwise manipulating promotional eligibility.
Where Flip Gear has reasonable evidence of promotional abuse, discretionary promotional benefits may be withdrawn.
8. Order Acceptance
Submitting an order does not prevent Flip Gear from subsequently cancelling it before fulfilment where there is a legitimate reason to do so and cancellation is permitted by law.
Reasons may include:
- Product unavailability
- Payment failure
- Fraud or security concerns
- Shipping restrictions
- Obvious pricing or technical errors
- Suspected promotional abuse
- Orders that cannot legally or operationally be fulfilled
Where Flip Gear cancels a paid order and does not supply the goods, amounts requiring reimbursement will be refunded appropriately.
9. Order Processing
Orders are generally processed within the timeframe stated in our Shipping & Fulfilment Policy.
Processing time and shipping/transit time are separate.
Processing may occasionally take longer during promotional periods, holidays, unusually high order volumes, stock transfers, or exceptional circumstances.
10. Order Changes & Cancellations
Customers wishing to change or cancel an order should contact Flip Gear as soon as possible.
Once an order has entered processing, packaging, fulfilment, or shipping, we may be unable to modify, intercept, or stop that shipment.
Where an order cannot be stopped, the customer should follow the applicable cancellation or return procedure.
Any statutory cancellation rights remain unaffected.
11. Shipping & Delivery
Shipping and delivery are governed by the Flip Gear Shipping & Fulfilment Policy.
Delivery estimates are based upon available carrier and fulfilment information and may be affected by international transit, customs, carrier operations, weather, public holidays, local delivery conditions, and other circumstances.
Where applicable law or an expressly agreed delivery term provides additional rights concerning delayed or failed delivery, those rights remain unaffected.
12. International Shipping
Where international shipping is available, customers acknowledge that shipments may pass through multiple countries, customs authorities, fulfilment facilities, and carrier networks before final delivery.
International orders may therefore experience additional transit or customs processing.
Where properly disclosed and legally the customer's responsibility, customers may be responsible for applicable customs duties, import taxes, brokerage fees, or government charges imposed independently by the destination country.
13. Tracking Information
Where tracking is available, tracking information will normally be provided after dispatch.
Tracking may take time to activate or may temporarily stop updating while an international parcel is moving between logistics facilities, undergoing customs processing, or being transferred between carriers.
A temporary absence of tracking updates does not necessarily mean that an order has been lost.
14. Customer Delivery Information
Customers are responsible for providing accurate and complete shipping information.
This includes the recipient name, complete address, postcode or ZIP code, apartment or unit information where applicable, country, and appropriate contact information.
Customers should contact Flip Gear immediately if they discover an error.
Once fulfilment has started, Flip Gear cannot guarantee that shipping information can be modified.
15. Failed Delivery & Unclaimed Parcels
Customers are responsible for reasonably cooperating with the delivery process.
A parcel may be returned because of an incorrect customer-provided address, repeated failed delivery attempts, failure to collect the shipment, or refusal of delivery.
Refusing delivery or intentionally failing to collect a shipment does not by itself constitute a properly submitted cancellation or return request.
Reasonable additional shipping, return, or reshipping costs may apply where legally permitted and attributable to the customer.
16. Returns & Refunds
Returns, refunds, replacements, discretionary compensation, return shipping, product inspections, and related matters are governed by the Flip Gear Return & Refund Policy.
Customers should contact Flip Gear before sending an item back so that appropriate return instructions can be provided.
The manufacturer, supplier, warehouse, or dispatch address shown on the original parcel may not be the designated return facility.
Nothing in our Return & Refund Policy removes remedies that customers are legally entitled to for faulty, damaged, incorrect, unsafe, or misdescribed goods.
17. Product Inspection & Evidence
Where a customer reports a damaged, defective, incorrect, or materially misdescribed product, Flip Gear may reasonably request information necessary to investigate the claim.
This may include:
- Order information
- Clear product photographs
- Close-up photographs of the reported problem
- Photographs of the packaging
- Shipping-label photographs
- Product labels or identifying information
- Other reasonable evidence relevant to the claim
Customers should retain the product and packaging while the claim is being investigated.
18. Product Use
Customers are responsible for using Flip Gear products appropriately and in accordance with any instructions, warnings, or care information supplied with the product.
Damage resulting from misuse, improper care, unauthorised modification, accidental damage after delivery, or use contrary to applicable instructions does not by itself establish that a product was defective when supplied.
19. Fraud, Abuse & Misuse
Flip Gear may take reasonable measures to protect customers and the business against fraud, return abuse, payment abuse, promotional manipulation, and other misuse.
This may include investigating:
- False non-delivery claims
- Fabricated or altered evidence
- Products deliberately damaged after delivery
- Different products being returned
- Duplicate refund or replacement claims
- Unauthorised use of payment information
- Promotion or discount manipulation
- Repeated abusive refund activity
Where Flip Gear has reasonable evidence of fraud or abuse, we may reject discretionary claims, restrict promotional privileges, cancel affected orders, or restrict future purchases where lawful.
Legitimate statutory consumer rights remain unaffected.
20. Chargebacks & Payment Disputes
Customers experiencing a problem with an order, payment, product, or delivery are encouraged to contact Flip Gear Support so that the matter can be investigated.
Where a chargeback or payment dispute is initiated, Flip Gear may provide relevant records and evidence to the applicable bank, card issuer, payment processor, or dispute-resolution provider.
Evidence may include:
- Order confirmation
- Payment records
- Checkout information
- Product information applicable when purchased
- Customer-provided shipping information
- Dispatch confirmation
- Tracking history
- Delivery confirmation
- Carrier evidence
- Customer communications
- Photographic evidence
- Refund or replacement records
- The policies and terms applicable when the transaction was entered into
Flip Gear reserves the right to contest payment disputes where available evidence indicates that an order was properly authorised, fulfilled, delivered, or otherwise handled in accordance with the applicable agreement.
Nothing in these Terms prevents a customer from exercising a lawful right to dispute an unauthorised transaction or exercise statutory consumer remedies.
21. Intellectual Property
Unless otherwise stated, Flip Gear's branding, logos, graphics, photographs, product imagery, videos, written content, advertisements, website design, and other intellectual property are owned by or licensed to Flip Gear.
You may not reproduce, modify, distribute, commercially exploit, or represent Flip Gear intellectual property as your own without appropriate authorisation.
22. Reviews & Customer Content
Customers must not knowingly submit false, misleading, unlawful, defamatory, fraudulent, or infringing reviews, photographs, comments, or other content.
Flip Gear may moderate customer-submitted content where reasonably necessary to remove unlawful, fraudulent, spam, abusive, or irrelevant material.
We will not knowingly publish or commission fake consumer reviews.
23. Third-Party Services
Flip Gear may use third-party services including payment processors, manufacturers, suppliers, fulfilment providers, shipping carriers, analytics providers, and technology platforms.
Certain third-party services may also be governed by their own terms and privacy policies.
Nothing in this section removes any responsibility that Flip Gear cannot lawfully exclude.
24. Website Availability
Flip Gear does not guarantee that the website will operate continuously without interruption.
We may temporarily suspend or modify website functionality for maintenance, technical updates, security, inventory management, or other legitimate operational reasons.
25. Limitation of Liability
To the maximum extent permitted by applicable law, Flip Gear will not be responsible for losses for which it is not legally responsible or losses that were not reasonably foreseeable when the applicable contract was entered into.
Flip Gear is not responsible for damage caused after delivery through misuse, improper care, unauthorised modification, neglect, or failure to follow applicable product instructions.
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
26. Privacy & Personal Information
Personal information is processed in accordance with the Flip Gear Privacy Policy and applicable data-protection requirements.
Information may be processed where reasonably necessary for order administration, payment processing, fulfilment, shipping, customer support, fraud prevention, refunds, returns, and payment disputes.
27. Changes to These Terms
Flip Gear may update these Terms where reasonably necessary to reflect changes to our business, products, services, technology, policies, or applicable legal requirements.
The terms applicable to an individual transaction will ordinarily be those properly incorporated into the customer's contract when that transaction was entered into, subject to any subsequent changes validly agreed or permitted by law.
28. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be treated in accordance with applicable law without automatically invalidating the remaining provisions where they can continue to operate independently.
29. Acceptance of Flip Gear Policies
By completing a purchase from Flip Gear, the customer enters into a contract with Flip Gear subject to the terms and policies properly presented and incorporated into that transaction at the time of purchase.
